State Pet Shop Laws: Oregon

Definitions:

  • Pet animal: any animal held, maintained or kept in captivity. (OR. ADMIN. R. 603-015-0025)
  • Pet shop or animal dealer: establishment operated and maintained for buying or receiving pet animals and exhibiting or selling or bartering such animals. (OR. ADMIN. R. 603-015-0025)

Vet Care:

  • N/A

Housing:

  • Pet shops must provide “sufficient protection” for pet animals in outdoor facilities. Cages must allow the animals to stand, turn around and lie down without obstruction. (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0045, OR. REV. STAT. § 596.990)

Lemon Laws:

  • Pet shops must provide vaccination records for pet animals to purchaser when requested. (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0060, OR. REV. STAT. § 596.990)

Food and Water:

  • Pet shops must provide pet animals with “palatable, wholesome” food that meets minimal nutrition. Fresh potable water must be offered twice daily and more often if weather warrants. (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0050, OR. REV. STAT. § 596.990)

Sanitary Conditions:

  • Pet shops must remove excreta from cages at least daily. Cages must be sanitized weekly and litter must be changed as it becomes soiled. (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0050, OR. REV. STAT. § 596.990)

Unweaned Animals:

  • N/A

Miscellaneous Provisions:

  • License not required for retail pet stores.
  • Pet shops must provide lighting to pet animals that is “good quality and well distributed.” (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0040, OR. REV. STAT. § 596.990)
  • Pet shops must provide adequate ventilation to exhaust “stale air, excess humidity and kennel odors.” 70-75 degree temperature is recommended. (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0040, OR. REV. STAT. § 596.990)
  • Pet shops must keep records of each pet animal for 12 months after sale. (Penalty: misdemeanor) (OR. ADMIN. R. 603-015-0060, OR. REV. STAT. § 596.990)

Notes:

  1. Where “adequate space” is not defined the state has not established a definition for the term.
  2. The definition of “animal” may actually be broadly written while the types of animals covered by the law (e.g., veterinary care, sanitation, food and water) may be more narrowly drafted.
