Definitions:

  • Animal: a dog or a cat. (MINN. STAT. ANN. § 325F.79)
  • Breeder: any person or firm that breeds animals for direct or indirect sale to the public. (MINN. STAT. ANN. § 325F.79)
  • Broker: a person or firm that purchases animals for resale to other brokers or pet dealers. (MINN. STAT. ANN. § 325F.79)
  • Pet or companion animal: a nonhuman mammal, bird, or reptile impounded or held for breeding, or possessed by, cared for, or controlled by a person for the present or future enjoyment of that person or another. Applies to §§ 346.35-346.44. (MINN. STAT. ANN. § 346.36)
  • Pet dealer: any person or firm, including a breeder, that is required to collect sales tax for the sale of animals to the public. Excludes animal shelters. (MINN. STAT. ANN. § 325F.79)

Vet Care:

  • Brokers and pet dealers must have cats and dogs examined by a vet prior to offering the cats and dogs for sale. [See the statute for details.] (Penalty: max $1,000 civil fine) (MINN. STAT. ANN. § 325F.791, MINN. STAT. ANN. § 325F.792)
  • “Commercial animal facilities” [not defined] must provide “adequate health care,” including pest and parasite control, to each pet or companion animal. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.37, § 346.36, § 346.44)

Housing:

  • “Commercial animal facilities” [not defined] must provide sufficient space for each cat or dog “to turn about freely and to easily stand, sit and lie in a normal position.” Minimum floor space equals length of animal + 25% squared and then divided by 144. Shade must be provided from May to October. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.39, § 346.36, § 346.44)
  • “Commercial animal facilities” must provide perches to birds “to allow the bird to roost without physical harassment from other birds.” (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.40, § 346.36, § 346.44)
  • “Commercial animal facilities” must provide cages to rodents that prevent escape or injury and provide protection from predators. Must have solid bottom impervious to moisture or wire that prevents leg/feet injuries. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.41, § 346.36, § 346.44)

Lemon Laws:

  • Pet dealers must give a written, signed info sheet to the buyers of cats and dogs. The sheet must disclose the health status, vaccination records, and owner history of the animal. (Penalty: max $1,000 civil fine) (MINN. STAT. ANN. § 325F.791, MINN. STAT. ANN. § 325F.792)
  • Pet dealers must post a consumers’ rights sign. Pet dealers must give a written consumers’ rights sheet to each buyer. The sheet must be signed by both parties. (Penalty: max $1,000 civil fine) (MINN. STAT. ANN. § 325F.791, MINN. STAT. ANN. § 325F.792)
  • Lemon law that offers recourse to those who purchase sick or diseased animals from pet shops. [See MINN. STAT. ANN. § 325F.791 for consumer remedies for the purchase of an ill or diseased animal.]

Food and Water:

  • “Commercial animal facilities” [not defined] must provide cats and dogs with sufficient food to allow for normal growth or maintenance of body weight per National Research Council standards. Also must receive clean, potable water in sufficient quantity to satisfy needs. Snow or ice is not adequate. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.39, § 346.36, § 346.44)
  • “Commercial animal facilities” must feed birds at least once daily with “wholesome, palatable” food that meets the normal daily requirements for the condition and size of the bird. Must also provide “clean, potable water in sufficient quantity.” (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.40, § 346.36, § 346.44)
  • “Commercial animal facilities” must feed rodents at least once daily with “fresh, wholesome, palatable” food sufficient to maintain “health and condition.” Pet rodents must receive sufficient “clean, potable” water. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.41, § 346.36, § 346.44)
  • “Commercial animal facilities” must provide rodents with chewing materials to prevent teeth overgrowth. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.41, § 346.36, § 346.44)

Sanitary Conditions:

  • “Commercial animal facilities” [not defined] must take measures to prevent cats and dogs from being contaminated with water, wastes and harmful chemicals. Bedding must be kept clean and dry. Outdoor enclosures must be kept clean and “base material replaced as necessary.” (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.39, § 346.36, § 346.44)
  • “Commercial animal facilities” must remove excreta regularly from bird cages. Cage, perches and food/water receptacles must be cleaned regularly. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.40, § 346.36, § 346.44)
  • “Commercial animal facilities” must regularly clean rodent cages and cover the floor with clean, dry bedding which must be changed at least weekly. If the cage becomes soiled or wet to a harmful degree, the animals must be transferred to clean quarters as soon as possible. Cage and water and food receptacles must be regularly cleaned. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.41, § 346.36, § 346.44)

Unweaned Animals:

  • Prohibits anyone from selling or offering for sale to an individual chicks, ducklings and goslings less than 4 weeks old. Exceptions for selling 12 or more birds simultaneously and for sales for “agricultural or wildlife purposes.” MINN. STAT. ANN. § 343.33)

Miscellaneous Provisions:

  • Retail pet store license not required.
  • “Commercial animal facilities” must maintain “suitable” temperature for dogs, cats, rodents and birds. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.39, § 346.40, § 346.41, § 346.36, § 346.44)
  • “Commercial animal facilities” must ventilate all indoor confinement areas for dogs, cats, rodents and birds to minimize drafts, odors and moisture condensation. Auxiliary ventilation must be used for rodents, dogs and cats when temperature rises to level that may endanger animal’s health. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.39, § 346.40, § 346.41, § 346.36, § 346.44)
  • “Commercial animal facilities” must provide 8 hours of illumination to indoor confinement areas for cats, dogs and birds. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.39, § 346.40, § 346.36, § 346.44)
  • “Commercial animal facilities” must provide “sufficient” lighting for rodents to allow routine inspection and regular cleaning. (Penalty: misdemeanor) (MINN. STAT. ANN. § 346.41, § 346.36, § 346.44)
  • Prohibits anyone from killing an animal using a decompression chamber. (Penalty: misdemeanor) (MINN. STAT. ANN. § 343.37)

Notes:

  1. Where “adequate space” is not defined the state has not established a definition for the term.
  2. The definition of “animal” may actually be broadly written while the types of animals covered by the law (e.g., veterinary care, sanitation, food and water) may be more narrowly drafted.
