State Pet Shop Laws: Michigan

Definitions:

  • Animal: a mammal except livestock and rodents. See Mich. Comp. Laws Ann. §§ 287.121 -.131 for livestock. (MICH. COMP. LAWS ANN. § 287.331)
  • Kennel: any establishment where 3 or more dogs are kept for sale, boarding, breeding, or training for remuneration. (MICH. COMP. LAWS ANN. § 287.270)
  • Pet shop: a place where animals are sold or offered for sale, exchange, or transfer. (MICH. COMP. LAWS ANN. § 287.331)

Vet Care:

  • N/A

Housing:

  • Pet shop cages must be “structurally sound” and in good repair with sufficient space for “each dog and cat to turn about freely and to easily stand, sit and lie in a normal position.” Floors must prevent dogs and cats from leg/foot injuries. (MICH. ADMIN. CODE r. 285.151.25)

Lemon Laws:

  • Pet shop operators must give a health certificate, health record, and vaccination record to buyers of cats and dogs. (Penalty: misdemeanor, license revocation and/or max $1,000 fine) (MICH. COMP. LAWS ANN. §§ 287.335a, 287.340, 287.339b)
  • Pet shop operators must ensure that cats and dogs that they bring into the state and offer for sale have been vaccinated. (Penalty: misdemeanor, license revocation and/or max $1,000 fine) (MICH. COMP. LAWS ANN. §§ 287.335a, 287.340, 287.339b)
  • Sellers of turtles less than 4 inches in length must give purchasers a salmonella warning sheet. (MICH. COMP. LAWS ANN. § 287.312)

Food and Water:

  • Dogs in kennels must be “properly fed.” (MICH. COMP. LAWS ANN. § 287.270)
  • Pet shops must feed dogs and cats at least once daily. Food must be “wholesome, palatable” and sufficient to meet normal daily requirements. Potable water must be offered twice daily for 1 hour. (MICH. ADMIN. CODE r. 285.151.31)

Sanitary Conditions:

  • Kennels must be “reasonably” sanitary. (MICH. COMP. LAWS ANN. § 287.270)
  • Pet shops must be clean, in good repair, and free of debris. (MICH. ADMIN. CODE r. 285.151.33)
  • Waste, bedding, dead animals and debris must be removed. (MICH. ADMIN. CODE r. 285.151.22)

Unweaned Animals:

  • Prohibits pet shop operators from importing into the state kittens or puppies less than 8 weeks old. Prohibits pet shop operators from offering for sale kittens or puppies less than 8 weeks old. (Penalty: misdemeanor, license revocation and/or max $1,000 fine) (MICH. COMP. LAWS ANN. §§ 287.335a, 287.340, 287.339b)

Miscellaneous Provisions:

  • License required for pet shops and kennels. (MICH. COMP. LAWS ANN. §§ 287.333, 287.270)
  • Pet shop animals can be confiscated or destroyed by agriculture department if the animals are suffering due to neglect or cruelty. (MICH. ADMIN. CODE r. 285.151.37)
  • Pet shops must keep the temperature in cat and dog facilities above 50 degrees. Ventilation must provide for the health and comfort of the animals at all times and must provide fresh air and minimize drafts, odors and moisture condensation. Light must be “ample” and allow routine inspection and cleaning. Cages must not allow “excessive illumination.” (MICH. ADMIN. CODE r. 285.151.23)
  • Pet shops must keep records for each cat and dog acquired or disposed of. Records must be kept for 2 years and the agriculture department can inspect them. (MICH. ADMIN. CODE r. 285.151.13)

Notes:

  1. Where “adequate space” is not defined the state has not established a definition for the term.
  2. The definition of “animal” may actually be broadly written while the types of animals covered by the law (e.g., veterinary care, sanitation, food and water) may be more narrowly drafted.
