State Pet Shop Laws: Illinois

Definitions:

  • Animal: any mammal, bird, fish, or reptile offered for sale, trade or adoption or for which a service is provided by any person licensed under this Act. (8 ILL. ADMIN. CODE 25.10)
  • Companion animal: an animal that is commonly considered to be, or is considered by the owner to be, a pet (includes equines). (8 ILL. ADMIN. CODE 25.10)
  • Dog dealer: any person who sells dogs, or offers to sell, exchange, or offers dogs for adoption with or without charge or donation. Excludes breeders who sell only their animals. (ILL. ANN. STAT. ch. 225, para. 605/2)
  • Exotic or non-domesticated animal: mammals, reptiles and birds that are not native to North America and are not normally maintained livestock, or native mammals that are not domesticated and normally maintained as pets. Includes prairie dogs. Excludes hamsters, guinea pigs, gerbils. (8 ILL. ADMIN. CODE 25.10)
  • Pet shop operator: any person who sells, offers to sell, exchange, or offers for adoption with or without charge or donation dogs, cats, birds, fish, reptiles, or other animals customarily obtained as pets. Excludes breeders who sell only their animals. (ILL. ANN. STAT. ch. 225, para. 605/2)

Vet Care:

  • Pet shops must take “reasonable care” to sell only animals that are free of disease or injury. (Penalty: license revocation) (ILL. ANN. STAT. ch. 225, para. 605/18, ILL. ANN. STAT. ch. 225, para. 605/10)

Housing:

  • Licensees must “provide adequate shelter for the comfort of the animals.” Cages must be able to “withstand” gnawing or chewing. (8 ILL. ADMIN. CODE 25.20)
  • Licensees must provide cages of “sufficient size” to allow animal to “comfortably stand, sit, or lie, and offer freedom of movement.” Housing for small animals, birds or fish must be at least 2½ times the body volume of the animals within. (8 ILL. ADMIN. CODE 25.20)

Lemon Laws:

  • Pet shop operators and dog dealers must provide vet care history, vaccination data, and ownership history of each dog and cat for sale. (Penalty: class C misdemeanor) (ILL. ANN. STAT. ch. 225, para. 605/3.1, ILL. ANN. STAT. ch. 225, para. 605/20)

Food and Water:

  • Pet shops must “provide adequate nutrition.” (ILL. ANN. STAT. ch. 225, para. 605/18)
  • Pet shop operators and dog dealers must provide “sufficient clean water and fresh food” daily to each animal. Young animals more often. Reptiles, fish and amphibians must be fed compatible with the species. (8 ILL. ADMIN. CODE 25.30)

Sanitary Conditions:

  • Pet shops must “maintain sanitary conditions.” (ILL. ANN. STAT. ch. 225, para. 605/18)
  • Pet shop operators and dog dealers must maintain premises in “sanitary condition” and “properly sanitize” with sufficient water pressure kennels, runs, equipment and utensils. (8 ILL. ADMIN. CODE 25.20)
  • Cleaning of animal housing must be performed daily or more often if necessary. (8 ILL. ADMIN. CODE 25.20)

Unweaned Animals:

  • Kittens and puppies must be 8 weeks old before dog dealers and cattery operators can separate them from their mother (for sale). (ILL. ANN. STAT. ch. 225, para. 605/2.2)

Miscellaneous Provisions:

  • License required for pet shop operators and dog dealers. (ILL. ANN. STAT. ch. 225, para. 605/3, ILL. ANN. STAT. ch. 225, para. 605/6.5, ILL. ANN. STAT. ch. 225, para. 605/9, ILL. ANN. STAT. ch. 225, para. 605/10)
  • Requires pet shop sellers of reptiles to post a specific notice cautioning of salmonella and provide a written paper to buyers. (ILL. ANN. STAT. ch. 225, para. 605/18.1)
  • Pet shops must “insure proper ventilation.” (ILL. ANN. STAT. ch. 225, para. 605/18)
  • Pet shop operators and dog dealers must maintain a specific ambient temperature for warm-blooded animals and for cold-blooded animals a temperature that is compatible to well-being of species. (8 ILL. ADMIN. CODE 25.20)
  • Pet shop operators and dog dealers must provide care and environmental conditions for reptiles, fish and amphibians “compatible” with the species. (8 ILL. ADMIN. CODE 25.30)
  • Pet shops must keep records of the chain of ownership of all dogs. Records can be inspected by state agriculture dept. (ILL. ANN. STAT. ch. 225, para. 605/2.2)
  • Pet shop operators and dog dealers must keep records of sale of each dog, cat, non-human primate, exotic or non-domesticated animal for 1 year. Must be available for inspection. Must submit annual reports to department for license renewal. (8 ILL. ADMIN. CODE 25.90)
  • State agriculture dept has exclusive jurisdiction to inspect the premises. (ILL. ANN. STAT. ch. 225, para. 605/18)

  • Prohibits anyone from knowingly poisoning a dog or other domestic animal or causing the poisoning of a domestic animal. Exception: with a permit for controlling transmissible diseases. (Penalty: class C misdemeanor) (ILL. ANN. STAT. ch. 510, para. 70/6)
  • Requires that all euthanasia drugs be used by or under the direction of a vet. (Penalty: class C misdemeanor) (ILL. ANN. STAT. ch. 510, para. 70/6)

Notes:

  1. Where “adequate space” is not defined the state has not established a definition for the term.
  2. The definition of “animal” may actually be broadly written while the types of animals covered by the law (e.g., veterinary care, sanitation, food and water) may be more narrowly drafted.
